Terms and Conditions for Medical Device Subscription

  1. Eligibility and NHS Patient Status
    • NHS Exclusive: This subscription is strictly for individuals currently receiving treatment from the National Health Service (NHS). By subscribing, you warrant that you are an active NHS patient.
    • Verification: We reserve the right to request proof of NHS treatment. Failure to provide this may result in immediate termination of your subscription.
  1. Payments and Non-Refundable Fees
    • Initial Payment: An initial fee of £149.00 is payable upon registration.
    • Non-Refundability: The initial fee of £149.00 is strictly non-refundable once the device has been dispatched or clinical setup has commenced. This fee covers administrative processing, clinical configuration for your NHS-aligned treatment, and initial delivery.
    • Monthly Subscription: A recurring fee of £14.95 will be charged monthly. Failure to maintain payments may result in the suspension of service and a requirement to return the device.
  2. Customer Service Hours
    Administrative and technical support is available during the following hours:
    • Monday to Thursday: 8:00 am – 4:00 pm
    • Friday: 8:00 am – 2:00 pm
    • Weekends & Bank Holidays: Closed.
    • Emergency Note: Our support team does not provide emergency medical care. In a medical crisis, contact 999 or your NHS clinician immediately.
  3. Safe Use and Contraindications (LLLT Therapy)
    • User Research: By entering this agreement, you confirm that you have researched the use of Low-Level Laser Therapy (LLLT) and understand its application for your specific condition as discussed with your NHS provider.
    • Strict Contraindications: The device must NOT be used in the following circumstances:
    • On individuals who are pregnant.
    • Directly on or near the eyes.
    • Over or near any active tumours or suspected cancerous lesions.
    • Assumption of Risk: You agree to follow all safety guidelines provided. Use of the device outside of these instructions is at your own risk.
  4. Limitation of Liability
    • Statutory Rights: Nothing in these terms excludes our liability for death or personal injury caused by our negligence, or for defective products under the Consumer Protection Act 1987.
    • Waiver of Non-Negligent Claims: To the fullest extent permitted by law, you agree that [Company Name] is not liable for any adverse effects resulting from the correct use of the device, or from your failure to adhere to the contraindications listed in Clause 4.
    • Liability Cap: Our total liability for any other claims (such as financial loss or service delays) is limited to the total subscription fees paid by you in the 12 months preceding the claim.
  5. Device Ownership and Returns
    • Ownership: The device remains the property of [Company Name] at all times.
    • Return Policy: Upon cancellation, you must return the device within 14 days in good condition. Failure to return the device will result in a charge for its full retail replacement value.

    • Data Privacy: Your personal and health data are processed according to the UK GDPR and the Data (Use and Access) Act 2025. Data is shared with your NHS team only for treatment or regulatory safety purposes.
  7. Governing Law
    These terms are governed by the laws of England and Wales. All disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
